GALERI USER AGREEMENT

1. Introduction

   1. Welcome to Galeri ("we," "our," or "us"). These Terms and Conditions ("Terms") govern your use of our platform, galeri.art, which connects artisans ("Sellers") with buyers ("Buyers"). By accessing or using our platform, you agree to comply with and be bound by these Terms. If you do not agree with these Terms, please refrain from using our services.

2. User Accounts

   1. Registration: Users must create an account to access certain features. You agree to provide accurate, complete, and updated information during registration and to maintain the security of your account credentials.

   2. Account Security: You are solely responsible for maintaining the confidentiality of your login information. Unauthorized access to your account must be reported to us immediately. We are not liable for any losses or damages resulting from unauthorized use of your account.

   3. Account Verification: We reserve the right to request additional verification (e.g., government-issued ID, proof of address) to prevent fraudulent activity.

   4. Account Suspension or Termination: Any violation of these Terms may result in temporary suspension, permanent termination, and/or legal action.

3. Fraud Prevention & Prohibited Activities

   1. Prohibited Conduct: Users may not engage in fraudulent activities, including but not limited to:

      1. Using stolen payment methods.
      2. Creating multiple accounts to manipulate transactions.
      3. Listing counterfeit, misleading, or illegal products.
      4. Engaging in deceptive pricing, false advertising, or scam transactions.

   2. Three-Strike System::

      1. 1st Violation: Warning issued.
      2. 2nd Violation: Temporary account suspension and funds frozen for review.
      3. 3rd Violation: Permanent ban and blacklist from the platform.

   3. Automated Monitoring: We use AI-based fraud detection to monitor transactions. Suspicious activity may lead to immediate account review.

4. Seller Policies

   1. Product Listings: Sellers must provide accurate descriptions, pricing, and images for their products. Misrepresentation of products is prohibited.

   2. Compliance: Sellers must ensure their products comply with all applicable laws and regulations.

   3. Order Fulfillment: Sellers must fulfill orders in a timely manner. Repeated failures may result in penalties or account suspension.

   4. Restricted & Prohibited Items: Items violating intellectual property rights, safety regulations, or legal standards are strictly forbidden.

5. Buyer Policies

   1. Purchases: Buyers agree to pay the full price, including any taxes and shipping fees.

   2. Chargebacks & Disputes: Buyers must contact the seller before initiating chargebacks. Unjustified chargebacks may result in account suspension.

   3. Blacklist System: Buyers engaging in fraudulent disputes or repeated policy violations will be permanently blacklisted.

6. Transactions & Payment Processing

   1. Order Acceptance: All orders are subject to seller acceptance. We reserve the right to cancel any order.

   2. Payment Processing: Payments are securely processed through our third-party provider. We do not store payment information.

   3. Escrow System: All transactions are placed in escrow on the platform until order completion to enhance buyer security and provide peace of mind.

7. Shipping and Delivery

   1. Shipping Responsibilities: Sellers must ship products promptly and provide tracking information where applicable.

   2. Risk of Loss: The risk of loss transfers to the buyer upon delivery to the carrier.

8. Returns, Refunds & Disputes

   1. Return Policy: Returns are subject to Galeri's platform standard return policy.

   2. Dispute Resolution: Buyers can lodge complaints regarding product issues, and sellers may provide evidence to counter claims. The Galeri team will review the dispute and make the final decision on whether an order qualifies for a return or refund.

   3. Platform Decision Finality: If a dispute is escalated, Galeri reserves the right to issue a final binding decision based on provided evidence.

9. Intellectual Property

   1. Platform Content Ownership: All trademarks, branding, and platform-generated content, including UI/UX design, text, and proprietary features, are the exclusive property of Galeri or its licensors.

   2. User Content & License: Sellers retain ownership of the products and original content they upload (e.g., product images, descriptions, and branding materials). However, by listing products on Galeri, sellers grant Galeri a non-exclusive, royalty-free, worldwide license to use, display, distribute, and promote such content within the platform and in external marketing efforts.

   3. Restrictions on Unauthorized Use: Users may not copy, reproduce, or distribute content from the platform, including other users' product images or descriptions, without explicit permission from the content owner.

10. Liability & Indemnification

    1. Limitation of Liability: To the fullest extent permitted by law, Galeri is not liable for indirect, incidental, or consequential damages arising from platform use.

    2. Indemnification: Users agree to indemnify and hold Galeri harmless from any claims, liabilities, damages, or expenses resulting from platform use or violation of these Terms.

11. Account Termination

    1. Suspension & Termination: We reserve the right to suspend or terminate accounts at our discretion without notice for any breach of these Terms.

    2. Permanent Blacklist: Users engaging in fraud, scams, or repeated violations will be permanently banned from using Galeri.

12. Governing Law

    1. These Terms are governed by the laws of Indonesia, without regard to conflict of law principles.

13. Changes to Terms

    1. We may update these Terms from time to time. Continued use of the platform constitutes acceptance of the updated Terms.
